This Privacy Statement (the “Statement”) describes how we handle such personal information when you check in our properties in Chinese Mainland, or when you register to check in our properties or use related services through our official website, WeChat public account (DIAOYUTAI MGM HOSPITALITY), or WeChat Mini APP (DIAOYUTAI MGM M life). The Statement also explains how you can exercise your related rights. At DIAOYUTAI MGM, we endeavor to provide our customers with the highest quality hotel products and services.

• 1. How We Collect and Use Your Personal Information

1.1 Check-in


To ensure that you can smoothly check into our properties and in compliance with relevant laws and regulations, we need to process personal information including your booking information, such as your name, email address, phone number, address, type of identification document, identification document number, payment information, facial recognition information (when required by authorities), etc.


1.2 Property Security Management


When you check into or stay at our properties, we may need to collect other personal information from you to ensure the safety and well-being of the property and its staff, guests, and visitors according to relevant laws and regulations. We deploy CCTV and other security measures in our properties to obtain or record images of guests and visitors in public areas, including information about your location within our properties.


1.3 Using Wi-Fi Services


When you use Wi-Fi services at DIAOYUTAI MGM properties, we may directly or through third parties collect information about the websites you visit, the type of device and browser you use, your device identification number (including:), your geographic location, bandwidth usage, session time, or other similar information.


1.4 Job Application


If you apply for a job at DIAOOYUTAI MGM or its properties, we may ask you to provide certain information about yourself, such as your employment and educational history, and your personal introduction/resume.


1.5 Log Information


When you visit websites of DIAOYUTAI MGM or its properties, or our social media pages, we may collect information about your purchases, reservations, and other consumption habits.


When you visit DIAOYUTAI MGM websites, we may collect information about the device and browser type you are using, the unique number assigned to your server or internet connection, your geographic location, and your interaction with the DIAOYUTAI MGM websites.


When you use integrated social media features on DIAOYUTAI MGM websites, mobile applications, or other social media sites, we may obtain information such as your name and email address.


1.6 Surveys


We may collect information about your consumption preferences from online or offline surveys, but the provision of information is on a voluntary basis.


1.7 Membership Services


M life Rewards participation: When you enroll in our M life Rewards membership program, you will receive an M life membership number, and you will also need to create a user ID and password. To manage your M life membership account, we also need to collect other relevant personal information, including transaction and communication details. The M life Rewards websites allow you to use your mobile device to manage your reservations, profile, consumption preferences, and concierge services. During the process, you may need to provide additional information, such as your preferred airline and your loyalty program account numbers with them, preferred room type and language, payment card account, and your email subscription preferences for receiving news, offers and information from us and our partners. Also, when you make reservations, including but not limited to making “Reward Reservations” online, we may also need you to provide other account details, such as company account, group or meeting code, or travel agency number, without which we cannot provide you with related services. If you apply for a payment card or other accounts with our partners via one of our advertisements or on our properties, you may have the option to automatically add this information as part of your M life Rewards membership profile. M life Rewards membership program (M life Rewards) is now officially launched, and you can sign up by providing your name in Pinyin, title, and phone number through the DIAOYUTAI MGM official website or DIAOYUTAI MGM M life Mini APP.

 

1.8 Purchasing Products


When you purchase products through the M life WeChat Mini APP, we need to collect your recipient information to deliver the products you purchased. This includes the recipient's name, phone number, and shipping address


1.9 Marketing


We may use information we collect about you for our own marketing purposes including notifying you of special promotions, offers and events via e-mail, direct mail, social media, telephone, text message, push notifications, and other means.  We will ask for your consent for our use of your personal information where required by applicable laws.


• Personal Information Collected from Third Parties


We may obtain your information from third parties, including entities directing you to Diaoyutai MGM properties, your family members and friends, airlines cooperating with us, credit card companies, and other business partners, to provide you with the above-mentioned services. In addition, we may also obtain information from your social media applications and other third-party sources. We will confirm the legitimacy of the source of personal information before obtaining such information, which will be used in accordance with the rules and policies set forth in this Statement.


• Sensitive Personal Information


In the process of providing you with services, we may process your sensitive personal information. We understand that if your sensitive personal information is mishandled, it may lead to an infringement of your personal dignity or a threat to your personal and property safety. To protect your legitimate rights and interests, we only process sensitive personal information that is necessary to provide you with the above-mentioned services, or in accordance with laws and regulations. We will take strict protective measures to ensure the safety of your sensitive personal information.


• Use of the Collected Personal Information


We may use the information we collect for non-marketing purposes including (1) validating your identity; (2) conducting statistical or demographic analysis; (3) processing, fulfilling, and tracking reservations, purchases, or other transactions; (4) complying with legal and regulatory requirements; (5) customizing your experience at Diaoyutai MGM Properties; (6) preventing fraud; and (7) cooperating with law enforcement or other government agencies for purposes of national security, public safety, or matters of public importance when we believe that disclosure of information is necessary or appropriate to protect the public interest (collectively “Non-Marketing Purposes”).

 

Although you may opt-out of the use and sharing of personal information for marketing purposes, we may still use and share information we collect for Non-Marketing Purposes.

  

• M life Rewards: If you are a member of the M life Rewards program, we may use your information to personalize your experience when you are using our products and services.  We may use your personal information to provide you news related to our services and products, marketing materials and personalize our advertisements and services through our web sites, email as well as our social pages. 


• Service Management: We also use your personal information to manage programs in which you participate. We provide you with access to your account, inform you of your status of your qualifications for our awards, and facilitate communications between our properties in terms of providing services and products as well as related matters.


• Meeting and Event Planning: We may use your personal information to provide you with information about planning for meetings and events.


• Personalize our Services: We may use the personal information we collect from you to improve and customize our services to you, based on the preferences which you have expressed. We can, for example, provide offers custom-made to your personal preferences.  


• Business purposes: We may use your personal information for data analysis, audits, security, monitoring and prevention of fraud, creating better products and services, improving our current products and services, and formulating strategies for new promotions, etc. 


• Emails, Text Message and Social Push Message: We may send you transactional or marketing messages through email, text messages and social push messages. As such, you should make sure that the email address, cellphone number and social media ID which you provide are accurate.

In order to provide you with the services you request, under legitimate, necessary, reasonable, specific conditions and with clear objectives, we may sometimes entrust relevant third parties to provide related services and process your personal information to fulfill these functions.

2.4 Transfer

• 3. How We Store and Protect Your Personal Information

3.1 Storage of Personal Information


3.1.1 Storage Location

When we provide you with hotel products and services, we may need to share your personal information with our properties. We will ensure that all such information transfers are conducted in accordance with relevant laws and regulations. Your personal information will be stored within China.

3.1.2 Storage Period

For personal information collected for the purpose of providing you with the above services, we will store it only for the minimum amount of time necessary to fulfill these functions, unless otherwise required by law. Typically, we use the personal data collected for room reservations and retain your personal data for a reasonable period. After the storage period expires, we will promptly delete or destroy your personal information to ensure that it cannot be recovered or reconstructed.

If the information is printed on paper, we will destroy it securely, such as by shredding or incineration. If the information is stored electronically, we will use technical means to delete the personal information to ensure it cannot be recovered or reconstructed.


3.2 Protection of Personal Information


Diaoyutai MGM shall take into consideration the technology, cost of implement and the nature, scope, context and purposes of processing personal information, as well as the risks for the rights and interests of the persons posed by processing. Diaoyutai MGM shall implement appropriate technical and organizational measures, such as pseudonymization, which are designed to implement data-protection principles, such as data minimization, in an effective manner and to integrate the necessary safeguards into the processing in order to protect the rights of the customers. Specific measures include:


(a)the pseudonymization and encryption of personal data;

(b)the ability to ensure the ongoing confidentiality, integrity, availability and resilience of processing systems and services;

(c)the ability to restore the availability and access to personal data in a timely manner in the event of a safety incident;

(d)a process for regularly testing, assessing and evaluating the effectiveness of technical and organizational measures for ensuring the security of the processing.


We have issued a code of conduct which protects the privacy of the personal information which we collect and protects the rights and interests of our customers according to laws and regulations. We have a team of information technology professionals who take effective and appropriate measures to ensure that the personal information we have is protected from unauthorized disclosure. The security team will manage and operate our security systems to protect your privacy and security when you use our products and services at our properties. Our code of conduct imposes an obligation on all of our staff and employees to take necessary precautions to prevent misuse and improper disclosure of the personal information which you provide to us as you use our products or services.


Diaoyutai MGM and its properties, as well as Diaoyutai MGM websites, WeChat public accounts, and Mini Apps store information on secure servers, which are protected by firewalls and other industry-standard security measures. These security measures aim to protect these servers from unauthorized access. We will take all appropriate measures to strengthen security systems (including server firewalls) to ensure that your personal information is securely protected when using our products and services.


We maintain a PCI compliance program. This compliance program generates audit reports concerning the adequacy and effectiveness of our IT related internal controls, including a PCI Attestation of Compliance signed by an external PCI Qualified Security Assessor. In the event of a security incident, we will notify regulators pursuant to applicable laws or regulations. We also request that our affiliates and service providers with whom we share personal information use reasonable care to maintain the confidentiality of personal information which they receive. For online transactions, we use all technological measures available to us to protect the personal information that we receive from you. Unfortunately, no security system or system of transmitting data over the Internet can be guaranteed to be entirely secure. Please do not send your payment card numbers or any other financial information to us by email.


We are not in a position to enforce or control the security of the computers, electronic devices or other electronic communication methods that you may use to send e-mails and submit information to us over the Internet. You are responsible for ensuring that the computers, electronic devices and electronic communication methods you use will provide adequate security for communicating with us or with others. We are not responsible for the disclosure or interception of information that you send us due to security breach on your devices or over the Internet not within our control.

We are not responsible for the way of collecting personal information or privacy practices of other web sites, including web sites operated by our business partners or other third parties. You should review and understand the privacy policies posted on any linked sites you visit before using those sites or providing any personal information on such web sites.


• 4.Your Rights

Our customers will have the right to require us to alter inaccurate personal data which they provide. Taking into account the purposes of the processing, our customers shall have the right to have incomplete personal data completed, including by making a supplementary statement.

Therefore, you will have the right to require us to alter, update, delete, or supplement your personal information on our files, and give or withdraw your consent for us to process your personal information at any time. For instance, you may log in to your personal account on our web site where you can change your personal information. Alternatively, you may also send an email to us (see Contact Information) and request us to amend your personal data on your behalf or to instruct us to stop sharing your information with third parties.


4.1 Accessing Your Personal Information


You have the right to access your personal information, except stipulated otherwise by laws and regulations. You can do so through various means on the user information pages. For example, you can log into the Diaoyutai MGM M life Mini APP, and click on “My Account” > “My Profile”, “Shopping Orders” or “Room Orders” to view your relevant information. Additionally, you can exercise your right to access by sending an email at any time to mlife@dytmgm.com, and we will respond to your request in accordance with the methods and timeframes outlined in this Statement. 


4.2 Copying and Transferring Your Personal Information


You have the right to obtain a copy of your personal information. You can send an email to privacy@dytmgm.com to make your request, and we will respond in accordance with the methods and timeframes outlined in this Statement. In compliance with the conditions set by the cyberspace administration of China, we can also provide you with a means to transfer your personal information to a recipient of your choice.


4.3 Correcting and Supplementing Your Personal Information


If you find that the personal information we process about you is inaccurate or incomplete, you have the right to update it through the Diaoyutai MGM official website by going to “M Life” > “Member Center” > “My Profile” or through the Diaoyutai MGM M life Mini APP by clicking on “My Account” > “Personal Information” > “My Profile”. If you are unable to update your personal information through the above methods or wish to correct your surname, first name, or date of birth, you can send an email to mlife@dytmgm.com or call 4009030228 to contact the M Life Service and Reservation Center to exercise your right to correct or supplement your information. We will respond in accordance with the methods and timeframes outlined in this Statement.


4.4 Deleting Your Personal Information


In the following cases, you can submit a request to us to delete your personal information, and we will respond in accordance with the methods and timeframes outlined in this Statement:

a)The purpose has been achieved, or cannot be achieved, or it is no longer required for such purpose;

b)We cease to provide products or services, or the retention period has expired;

c)You have withdrawn your consent or canceled your account;

d)You believe that we have processed your personal information in violation of laws, administrative regulations, or agreements;

e)Other circumstances as stipulated by laws and administrative regulations.

Please note that if the retention period stipulated by laws and administrative regulations has not expired, or if it is technically difficult to delete personal information, we may not be able to delete your personal information as per your request, but we will cease processing it except for storage and necessary security measures.

If we decide to respond to your deletion request, we will also notify entities that we have entrusted to receive and process your personal information to delete it promptly, unless otherwise stipulated by laws and regulations or these entities have obtained your independent authorization or re-obtained your consent.


4.5 Canceling Your Account


If you need to cancel M Life account, you can send an email to mlife@dytmgm.com to submit your cancellation request, and we will respond in accordance with the methods and timeframes outlined in this Statement. You agree to properly handle any agreements made with us or through us with third parties, ensuring that all agreements are fulfilled and that there are no disputes before canceling your account.


After canceling your account, we will stop providing you with products or services, and delete your personal information upon your request. However, to prevent and investigate misconduct (for example, to prevent malicious purchases and obtaining benefits through unfair means, using false identification or credentials by canceling accounts or deleting personal information), We may continue to retain some of your personal information for a reasonable period of time after you have deactivated your account, as permitted by laws and regulations, for verification purposes.


4.6 Withdrawing Consent


The services described in this Statement require some basic personal information. For the personal information that we process based on your consent, you can manage your authorization and consent by disabling device features, etc.

We will not subject you to unreasonable differential treatment in transaction conditions such as prices. 4.9 Responding to the Above Requests


To ensure security, you may need to provide a written request or otherwise prove your identity. We may ask you to verify your identity before processing your request.


Generally, we will respond within 15 working days, unless otherwise stipulated by laws or administrative regulations. If you are not satisfied, you can file a complaint through the contact information provided in the "How to Contact Us" section at the end of this Statement.


For your reasonable requests, we will not charge any fees in principle, but we will charge a certain amount for repeated requests beyond a reasonable limit. We may refuse requests that are groundlessly repetitive, require excessive technical means (e.g., the development of new systems or fundamental changes to current practices), pose risks to the legitimate rights and interests of others, or are very impractical (e.g., involving information stored on backup tapes).


We will not be able to respond to your requests in the following circumstances as required by laws and regulations:


a)Related to our fulfillment of obligations stipulated by laws and regulations;

b)Directly related to national security and defense;

c)Directly related to public safety, public health, and significant public interest;

d)Directly related to criminal investigations, prosecutions, trials, and execution of sentencing;

e)When there is sufficient evidence to prove that you have malicious intent or are abusing rights;

f)For the sake of protecting significant legal rights and interests such as life and property of yourself or others and it is difficult to obtain your consent;

g)Responding to your request would cause serious damage to the legal rights and interests of yourself or other individuals or organizations;

We process the personal information of children under 14 years old with the consent of their guardians. We will make every effort to verify whether guardians have provided consent in accordance with relevant laws and regulations.


We will not intentionally and directly collect or allow others to collect personal information from minors under 14 years old.
